Canaries in a coal mine: Rule of law deficiencies and mutual trust

The value decline in the EU has manyfold consequences. It jeopardizes very essence of Europe as a community values. At same time it endangers legal principles, such mutual recognition, which is based on trust presuming that all Member States are rule law and protect fundamental rights. Once rebutted, States' judicial authorities will refuse to cooperate recognise each other's judgments order not become complicit individual rights violations contradict European Convention for Protection Human Rights Fundamental Freedoms. This paper argues must allow considerations suspend recognition-based laws only case-by-case basis, happens today practice, but general with regard undergoing decline, uphold EU's culture, law's equivalency Convention's human regime.
